The Corporate Manslaughter and Corporate Homicide Act 2007 ensures companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care.
All employers have a duty to provide a safe environment according to the following statutory regulations:
- Health & Safety at Work Act 1974 Section 2
- Management of Health and Safety at Work Regulations 1992
- Provision and use of Work Equipment Regulations 5 and 6 1998

Any piece of work equipment must comply with Provision and Use of Work Equipment Regulations 1998 (PUWER). The Regulations demand that any risks to people's health and safety, from equipment that they use at work, must be prevented or controlled.
In general terms, PUWER require that equipment provided for use at work (this includes racking and all other forms of storage equipment) meet relevant standards. You could be exposing yourself and your company to prosecution if you cannot demonstrate compliance within the following criteria.
- Equipment is suitable for the intended use.
- Equipment is safe for use, maintained in a safe condition and inspected to ensure this remains the case;
- Equipment used only by people who have received adequate information, instruction and training; and
- Accompanied by suitable safety measures, eg protective devices, markings, warnings.
